Alternate Dispute Resolution

The Alternate Dispute Resolution (“ADR”) practice focuses on resolving disputes in a pragmatic manner with the intent to avoid procedural delays and achieve effective results for clients within the legal system especially after the recent amendments to the Arbitration and Conciliation Act, 1996. Ivy Law has extensive experience and expertise in handling arbitrations, mediations, conciliations and negotiations on behalf of our clients in varied sectors such as government disputes, real estate, infrastructure, oil and natural gas etc. With the advancement of superior arbitration systems, complex issues relating to enforcement of judgments and arbitration awards, Ivy Law has a strong collaboration with specialized experts to provide their sector expertise in these matters.

Broadly, our scope of work in ADR includes:

  • Advising clients on alternative dispute resolution laws and procedures, formulation of dispute resolution strategy, dispute resolution clauses and agreements and public policy issues.

  • Assisting and drafting of stay proceedings brought in breach of arbitration clauses.

  • Advising on potential disputes relating to mediation and settlement processes between the parties.

  • Drafting and vetting of arbitration agreements, necessary pleadings and statements.

  • Assisting in setting aside or execution of awards within and outside India and challenging the enforcement of arbitral awards.
